Immigration problems

You may be facing opposition from INZ regarding your application, including with medical or character issues, you're here unlawfully, or liable for deportation. You may have had your residence visa declined and want to appeal to the IPT. I can help with these issues. For example, every s61 request, medical and character waiver I've done since starting in 2019 has been approved.

Regularising your Immigration Status

If you find yourself no longer meeting visa conditions or you're residing in New Zealand unlawfully, it can be a challenging situation. You may even receive a Deportation Liability notice and/or a Deportation Order from Immigration New Zealand. At Hennessy Immigration, I specialise in resolving these complex situations. Each client's circumstances are unique and demand diligence, accurate advice, and effective advocacy to help them achieve lawful status in New Zealand or obtain a visa they may not have otherwise qualified for.

Section 61 requests

If you've become unlawful, an (Immigration Act) Section 61 Request is required. This involves making an appeal to the Minister of Immigration, who possesses unfettered discretion to grant a visa under this section of the Immigration Act. I have done a number of these to date and all have been successful. In emergency situations, I have managed to get them through in one day.

Request for reconsideration

In the event of an unfavorable outcome, it may be prudent  to pursue a request for reconsideration. This becomes relevant when a visa application is declined for various reasons, and there's a potential that immigration officials didn't consider all relevant information or new circumstances have emerged, or subsequent, material information comes to light that wasn't able to be viewed previously

Special directions

Depending on your specific circumstances, Hennessy Immigration can initiate a request for a 'special direction' on your behalf. This is also allowed for under the Immigration Act, and is used only in desperate situations usually.

Character and medical waivers

Depending on your individual circumstances, a character or health requirement waiver could be the most suitable solution to address your immigration challenges. It is usually a matter of having to do it, rather than choosing to, if you want your application to proceed. Similarly, medical issues can pose a barrier to immigration and for children, disorders that make them eligible for special education services will also make immigrating difficult, or impossible. I can assist with these, and tell you whether there is any use in applying or whether it is better to consider migrating somewhere else.
